Australia has launched the ‘Workplace Justice’ subclass 408 Visa to address workplace injustices that may be faced by temporary visa holders. By allowing temporary workers to seek legal remedies without fear of visa cancellation, Australia reaffirms its commitment to justice and equality.
A brief summary of this new visa stream is provided below.
Purpose
This visa helps workers who have been exploited or mistreated while working in Australia.
Eligibility
Current visa holders, and those without visas, can apply for the Workplace Justice visa if they have experienced workplace exploitation in Australia. Applications for this visa must be accompanied by valid certification issued by a relevant government authority regarding the worker exploitation matter which details the ongoing complaint investigation, criminal or civil proceedings.
There is no charge for the visa and family members of the affected worker are also covered, ensuring support during the process.
Duration
The visa may be granted up to 4 years, with work rights, depending on the nature and expected duration of the ongoing workplace justice activities.
