Under the new arrangements, Hong Kong citizens who are in Australia on a student visa will be eligible for a 5-year temporary graduate visa once they successfully complete eligible tertiary studies.
The new arrangements include the following provisions:
- Current holders of a Subclass 485 temporary graduate visa will be given an extension of up to 5 years, starting from 9 July 2020
- These graduates will also have a pathway to permanent residency after 5 years or 3 years for those who studied and live in regional Australia (if they have qualifications on the Occupation Skills Lists and meet the Labour Market requirements or qualify for the Global Talent temporary visa scheme for exceptionally talented applicants sponsored by an employer for a salary above the Fair Work High Income Threshold of $153,600).
More details about the pathway to permanent residency will be released by the Department of Home Affairs when available.
If any of the above circumstances apply to you or you have any other concerns regarding your visa and legal status in Australia, contact us for individualized advice.
We will continue to provide updates as more information becomes available.
